To the fullest extent permitted by New York law, FactsChecks.com, its operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site or its content — including but not limited to damages for loss of profits, data, or goodwill — even if advised of the possibility of such damages. This is a free, non-commercial hobby site and our maximum aggregate liability to you for any claim is zero US dollars ($0.00).

You agree to indemnify, defend, and hold harmless FactsChecks.com and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or violation of these Terms.

12. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict-of-law principles. You irrevocably consent to the exclusive jurisdiction of the state and federal courts sitting in New York for resolution of any dispute arising from these Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and Affiliate Disclosure, constitute the entire agreement between you and FactsChecks.com with respect to the use of the Site.
